These Standard Terms apply to the use by you of TelstraClear Prepaid Phone Cards. Your contract is with TelstraClear Limited. Use of this card constitutes acceptance of the terms and conditions stated.
1. Provision of Services
TelstraClear will use all reasonable efforts to provide reliable and high quality Services however does not guarantee the availability of Services or that Services will be continuous or fault free. Any Service inquiries or problems should be directed to Customer Services by phoning 0508 508 773 Toll Free.
2. Charges
2.1 General
- Other than Cheap Chat, rates include GST and are charged on a minute plus minute basis.
- Rates are for calls to and from landlines (unless otherwise stated).
- Rates are effective from 01 April 2008 and are subject to change without prior notice.
- For calls from hotels/motels extra charges may apply.
- Credit balances are not refundable or transferable.
- Charges for Services vary according to card type. Details of the applicable charges may be obtained from www.prepaidcards.co.nz, from TelstraClear customer services free of charge or the rate sheet given to you when you purchase the card.
- Different charges apply depending on whether calls are made via a local access number or a national access number. Calls made using a national access number incur an additional 10c per minute.
- When making a local access call from a payphone or mobile phone, usual pay phone or mobile phone charges apply before a call can be made.
- Call records shown as used on the card are agreed by you to be final proof of calls made and call duration.
2.2 Cheap Chat
Rates exclude GST and are charged on a minute plus minute basis. A 9c + GST connection fee applies to all calls after the first minute. Calls from payphones incur a 27c +GST per minute surcharge and calls from mobile phones incur a 40c +GST per minute surcharge.
2.3 Talk Talk
Calls using national access numbers from payphones incur a 49c per minute surcharge and from mobile phones incur a 49c per minute surcharge.
2.4 Pacific Talk
Calls using national access numbers from payphones incur a 35c per minute surcharge and from mobile phones incur a 49c per minute surcharge.
2.5 e-Phone
A 29c connection fee applies to all calls after the first minute. Calls using national access numbers from payphones incur a 35c per minute surcharge and from mobile phones incur a 45c per minute surcharge.
2.6 TalkPlus Global
Calls using national access numbers from payphones incur a 35c per minute surcharge and from mobile phones incur a 45c per minute surcharge.
Calls back to New Zealand are charged as follows - rate from New Zealand to the originating country + 18c per minute surcharge. Calls to a third country are charged as follows - rate from New Zealand to the originating country + rate from New Zealand to the destination country + 18c per minute surcharge.
3. Amendments to Standard Terms
TelstraClear may amend or replace these Standard Terms from time to time.
4. Use of Services
You may not use, or allow anyone to use the Services for any unlawful purpose or in a manner that may cause damage to TelstraClear's network or interfere with the provision of Services to other customers.
5. Our liability to you
To the extent allowable by law:
- our liability for any claim, damages, loss or expense that you incur as a result of anything we have done or not done is limited to TelstraClear’s standard charge for providing the Service giving rise to the claim against TelstraClear ; and
- we will not be liable for any loss of profits or any consequential, indirect or special damage, loss or injury of any kind suffered by you or any other person.
6. Liability of third parties to you
The following people will not have any liability to you:
- our employees, contractors and representatives;
- other network operators who use our network and allow us to use their networks, and their employees, contractors and representatives; and
- any person who provides any service, which is part of our services, and their employees, contractors and representatives.
7. Nature of Prepaid Phone Card
Charges for calls made using the Prepaid Phone Card will be debited against the credit balance on the card. The calls can be made by anyone who is aware of the card number. Therefore you should keep the access number confidential to prevent misuse and should protect the card as securely as cash. TelstraClear is not liable to you for any loss arising out of misuse, loss or theft of the Prepaid Phone Card or associated card number. Prepaid Phone Cards are not redeemable for cash.
